In searching for information about this story I bumped into some other similar reports. One was reported by The Sun newspaper on 5 June 2019. The one I’m referring to today was reported on 26 November 2019.
Nottingham, UK: The RSPCA are appealing for help to find a person who sexually abused a kitten leaving the cat with horrific injuries. The kitten was found by member of the public. He is a male kitten of nine-weeks-of-age.
He sustained injuries to his rectum and he was covered in mud and faeces when veterinarians dealt with him. He was taken to an emergency veterinary treatment centre where the veterinarians decided that he had been sexually abused.
“When I collected the kitten I could see he was trying to defecate but was really struggling and he was so swollen around the rectum that I couldn’t tell what sex he was. He was also covered in faeces and very skinny.” RSPCA Animal collection officer Hayley Day
In the title I have used the words rape, bestiality and buggery. This is because, in this instance, they are interchangeable and/or overlapping.
We know what bestiality is but for the sake of clarity it is sexual intercourse between a person and an animal. Sexual intercourse is sexual contact between individuals involving penetration, especially the insertion of a man’s erect penis. According to this definition social intercourse does not have to include the insertion of a penis into the vagina.
Buggery is interesting from a legal perspective because in the UK, under the Offences Against The Person Act 1861:
“Whosoever shall be convicted of the abominable crime of buggery, committed either with mankind or with any animal, shall be liable, at the discretion of the court, to be kept in penal servitude for life or for any term not less than 10 years.”
The definition of buggery is anal intercourse and in law it also covers bestiality.
So this person who is being sought by the authorities committed an act of buggery with an animal which is bestiality and which is also sexual intercourse on my interpretation of the law and the definitions.
Interestingly, if he is found, tried and convicted under the Offences Against The Person Act 1861 he would receive at least a 10 year prison sentence which is far longer than he would receive if he was tried and convicted under the Animal Welfare Act 2006 (51 weeks I believe).
I think that I have assessed this correctly and if so it is quite interesting but this crime, of course, is absolutely disgusting. The report does not tell us whether this unknown person penetrated this poor kitten’s anus with his penis or with another object. I wonder whether they are able to tell. They probably can and it would be nice to know their assessment.
However, in my view, it doesn’t change the severity of the crime or the punishment.
