Lawyer for Kristen Lindsey defends his client in letter to Texas Board of Veterinary Medical Examiners

The attorney, Brian W. Bishop, is representing Kristen Lindsey in her defense against the investigation by the Texas Board of Veterinary Medical Examiners (TBVME) to sanction Dr Lindsey for her alleged killing of a domestic cat (claimed to be feral) with a bow and arrow at close range. Most of us have heard about this notorious case. If not, please click this.

Mr Bishop must also be representing and defending Kristen Lindsey generally. I believe Brian W Bishop has his own law firm in Austin Texas (900 West Avenue).

Update at 1st June 2015: his website is currently down probably as a consequence of acting for Kristen Lindsey. A visitor to PoC, kindly provided his details in a comment.

A colleague of mine has kindly sent me a copy of a leaked letter that Mr Bishop wrote to the TBVME. It is reproduced below and I have typed it out as the image is small and hard to read.

Letter from lawyer to Texas Board

Dear Ms Hudson,

This firm represents Dr. Lindsey DVM in the referenced complaint.

Dr. Lindsey denies that she engaged in any violation of Board Rule 573.4. Among other things, neither the act of posting of a photograph, nor this alleged act of killing of a ferel [sic] cat on Dr. Lindsey’s residential property were “connected to the practice of veterinary medicine’ or otherwise a criminal activity.

Please cease and desist from any further attempts to contact Dr. Lindsey or her family. Also as you are aware, TBVME complaints are confidential per Texas Occ. Code § 801.207 – the TBVME has, however, been discussing the complaint and related matters with third parties (including Dr. Ron Stried DVM) in flagrant disregard of Dr. Lindsey’s right to privacy and confidentiality – these disclosures must stop immediately.

My comment (please add your below): firstly I apologise for adding to Dr Lindsey’s lack of privacy in this matter but feel it needs to be aired due to public interest.

The key statement, I believe, is that the lawyer claims that Lindsey’s alleged killing of Tiger, the ginger tabby, is unconnected with the practice of veterinary medicine.

I strongly disagree with this. It has to be closely connected to the work of a vet because the attitude and behavior of a vet outside of her/his workplace is critical to (a) the standing of the veterinary profession generally in the USA and further afield and (b) the way a vet conducts herself at her workplace.

The work of even the most highly skilled veterinarian will be compromised if the vet in question has a poor attitude towards animal welfare. Compassion is a key characteristic of the good veterinarian. You could argue that it is essential.

Judging by the behavior of Dr Lindsey she has a poor and unsuitable attitude towards the welfare of animals. There was not an ounce of compassion in her alleged close range shooting of her neighbor’s cat.

Whether what she allegedly did is criminal or not is down to a court to decide. However, the broad opinion on the internet, where this notorious example of cat cruelty has been widely discussed, is that she committed a crime and should be punished accordingly.

I am surprised that Mr Bishop is demanding that the TBVME should stop contacting people other than Lindsey because how else can they investigate the matter?

  1. I am from NJ and have been following the KL story daily from day1. Like Shannon who posted earlier I take solely take care of 3 feral cat colonies and have house cats that I cherish dearly. I have one house cat who I named Big Herman he looks so much like Tiger he was a scared feral that I worked with on a daily basis for months until I gained his trust he now is a permanent house boy and because of my Big Herman I will not rest until Kristen Lindsay pays dearly for what she did to poor Tiger his misfortune was to wander onto her property I cannot fathom that a licemsed veterinarian could commit such a crime she truly is a sociopath. I read a blog on another site posted by Feline Mom she described how the most famous serial killers in the US got there start and all of them started their killing sprees by practicing on innocent animals before they went onto murder human beings. KL in her own words described on her blog that she enjoyed killing animals. What does attorney Brian W. Bishop think about that when he decided to represent KL? We know that DA of Austin County did not do his job because the grand jury failed to press charges against KL for animal creulty which was a major dissapointment but was not shocking because of the DA’s soft response to animal creulty cases during his tenure. Now the ALDF has stepped up and has asked the DA under Tx law to be able to review his file I think most of us know he won’t do that and that our only hope is that KL will lose her vet license because of the other organizations involved who have taken a stance against her. We the public the animal lovers cat lovers must keep the pressure up to make sure that KL never is able to practice veterinary medicine again in her life. I’m a firm believer in Karma she will pay for what she did to Tiger for the boasting hopefully she’s checked that big old ugly ego in at the door if not hopefully she will soon. Realistically what animal person would ever let them have her treat their beloved pet? KL is probably the most hated woman in the world right now and she can hang out with Casey Anthony the witch that killed her daughter in Florida but got off scott free there’s another one who will face Karma .RIP Tiger you will never be forgotten and your sweet spirit lives on in our of our beloved pets all we have to do is look into their eyes.

  2. The only thing I have a problem with is, since when do you run around with a bow and arrow. The only time I have seen anyone with a bow and arrow is when they are hunting. Did Ms. Lindsey have the concept that she was hunting when she shot the cat. She must of been lying in wait.
    After all who hangs out with a bow and arrow. The whole idea was very clear with this kill. Ms. Lindsey had her own objective when she shot that arrow. It could of been, my cat, the neighbors cat, your cat, animal that happened to there was going die.
    The motive for doing this is rabies, it’s her desire to “kill” This whole concept needs to looked at. Just as well as posting that her was her “first kill” with a bow and arrow. How long has she been doing target practice with animals? It would appear that she has intentions on doing another and another.
    The FBI should get involved, she fits the exact profile for potential mass murderer. Along with the
    added comment “I am awesome and still has her job”
    Her inflated ego, and complete attitude that this was acceptable. Her parents watched this, happen and later said that she lost her phone. Now come on, how long can you cover for your daughter? You condone the thing in a post on facebook. They are as twisted as her thinking.
    Lastly, I would like to comment on the “evidence” in this case. In California we consider posting the evidence on Facebook to be a self confession. It is completely admissible in a court of law here. There is enough evidence to convict with that post and picture. What did she do with the body? There are guidelines if she thought it was rabid, there is a process that she need to follow for the disposal animal with rabies. She failed there again. Along with the illegal method of ending the cats life. There are so many issues in this case that I could go on and on. For now these are the questions I have gone over and over again. I come up with the same answers.

She took an oath that’s no different than a human physician/doctor taking the same oath except for humans..so where’s the difference & further more what’s even scarier are all these people along with Kristen who think there’s nothing wrong with this infamous act!

  5. Hi Jamie. Thanks for commenting. Where did you get the 24th hearing date from? I don’t remember reading that. As for the law, it is legal to shot feral cat in the state where she lives but under certain circumstances. In fact the attorney’s letter refers to an except or defence to animal cruelty and it refers to a cat harassing livestock. As I read the situation the cat was a domestic cat and it was not harassing livestock. It is believed that Lindsey called it over and it came or perhaps he was trapped.
